A screenshot of a block explorer is not evidence. It's a starting point. That's usually the first thing I tell lawyers who come to me having "already checked the blockchain" and found where the money went. They're often right about the facts. But there's a wide gap between knowing something happened on-chain and having a report that will survive scrutiny from a judge, opposing counsel, and an opposing expert. After eight years building and running fintech and crypto ventures — including a crypto hedge fund and a financial consulting practice involving DeFi products and custom smart contracts — and years since spent conducting blockchain investigations for law enforcement, law firms, and private clients, I've come to see that the difference between a "lookup" and "evidence" is almost never about the tools. Anyone can run an address through an explorer. What matters is whether the process behind that lookup can withstand someone trying to take it apart.

The Gap Between "I Checked the Chain" and Actual Evidence

Public blockchains are, in one sense, the most trustworthy data source available — immutable, decentralized, and open to anyone's verification. The problem is never the raw data; it's the interpretation. Which address belongs to whom, which transactions are meaningfully connected, whether funds routed through a mixer or a cross-chain bridge break the evidentiary trail or merely obscure it temporarily — none of that is answered by simply reading a ledger entry. A court-ready report doesn't stop at "Address A sent 12 ETH to Address B." It documents how that conclusion was reached, what assumptions were made along the way, and what corroborating sources, if any, tie an address to a real-world identity.

Chain of Custody: It Applies to Digital Data, Not Just Physical Exhibits

Many lawyers assume chain of custody is only relevant to physical evidence — a hard drive, a phone, a paper file. In practice, it matters just as much for blockchain data. Every query, every data export, every use of a third-party analytics tool needs to be documented: when it was run, by whom, with which tool and version, and exactly what was retrieved. If a report relies on data pulled months before it's submitted with no record of when or how it was collected, opposing counsel has an easy opening — arguing the data may have changed, that the address received additional activity in the interim, or that the investigator simply can't prove what they actually saw at the time. Proper custody means an organized activity log, retention of raw data alongside the final analysis, and timestamps that can be independently verified. It sounds bureaucratic, and that's precisely the point — the goal is that every step of the work can be reproduced and audited by another qualified expert, including one retained by the other side.

Methodology Transparency and Reproducibility

A report that leans on "I recognize money-laundering patterns" without explaining how is a fragile report. Transparent methodology means every claim rests on a process that can be described in plain language: which analytics tools were used, what criteria established a link between addresses (common ownership, a repeated transaction pattern, shared use of a centralized service), and which alternative explanations were considered and ruled out. A serious blockchain investigator doesn't present only the strongest conclusion — they show the alternative theories that were tested and eliminated. Reproducibility, meaning that another qualified expert working from the same underlying data would reach the same conclusion, is the real test. When an opposing expert asks "how did you get there," the answer needs to be documentation, not recollection or instinct.

Corroborating On-Chain Findings With Off-Chain Evidence

This is arguably the most important section for a legal team, and often the most neglected. On-chain data alone, in most cases, does not prove identity. It proves the movement of value between addresses. The link between an address and a real person or entity is established by pairing the on-chain finding with off-chain evidence: exchange KYC responses, subpoena returns, public records, lawfully obtained IP or metadata, and sometimes ordinary witness testimony. A strong investigation builds a bridge between the digital and the evidentiary-legal world rather than resting on either alone. When counsel is deciding whether to send an exchange a request or a subpoena, it's worth doing so early — exchange responses take time, and often need to be framed with precise legal and technical language to actually yield a useful answer. An experienced blockchain investigator knows how to help shape those questions before the subpoena goes out, to maximize the odds of getting a response that actually strengthens the case.

Visualizing the Flow of Funds Clearly

A judge, a jury, or opposing counsel doesn't necessarily understand blockchain mechanics, and a technically excellent report that fails to communicate the story clearly simply hasn't done its job. A clean flow diagram, showing source, destination, and intermediate hops with timestamps and amounts, turns a complex case into an accessible narrative. It matters that the diagram doesn't oversimplify — that it doesn't quietly drop steps or smooth over uncertainty just to look tidier. Good visual documentation explicitly distinguishes high-confidence links ("direct connection, confirmed via KYC response") from reasonable inferences ("circumstantial link, based on behavioral pattern"). That distinction is what determines whether a piece of evidence gets treated as conclusive or merely supportive.

Expert Witness Readiness and Common Pitfalls

An investigator who expects to serve as an expert witness needs to build the report with that role in mind from day one, rather than writing an internal summary and retrofitting it for legal use later. That means a clear professional CV, full disclosure of any potential conflicts of interest, and the ability to explain conclusions in plain language under cross-examination. The most common mistakes I've seen, including from others in this field: relying on a single automated tool without independent verification; using absolute language ("proven beyond doubt") when the data actually supports high probability rather than certainty; skipping intermediate hops in a transaction chain; and failing to keep documentation that lets the opposing side actually check the work. Any one of these is enough to get an otherwise sound piece of evidence weakened or excluded, even when the underlying conclusion is correct.
